Can A Claimant Collect Both Unemployment and DBL During The Same Period?

No. Claimants can not collect Unemployment Insurance & DBL Benefits for the same period of time.

When Will A Claim Be Paid?

A claim will be paid 14 days after the disability or four business days after the claim is received, whichever is later, providing all information is correct.

Is The Cost of Medical Care Included?

No. The cost of medical care is not included.

Is An Employee Eligible For Disability Benefits If They Work For Remuneration or Profit?

An employee is not eligible for disability benefits if they work for remuneration or profit, even if done at home.

Can A Claimant Collect DBL Disability Caused By Pregnancy?

Yes. A claimant can collect DBL for disability caused by pregnancy.

Can Claimant Collect DBL and Social Security At The Same Time?

Yes. A claimant can collect DBL and Social Security at the same time.

If A Claimant Is InvolvedI In An Auto Accident, Are Entitled To DBL?

Yes, but it may reduce any no-fault insurance benefits. DBL benefits are primary.

What Do I Do If A Claim Is Rejected?

A rejected claim may be reviewed by requesting a hearing by filling out the reverse side of the Notice of Rejection and mailing it within 26 weeks.

How Does An Employee File For Benefits?

The employee should file a Claim Form (DB-450) with their employer. The claimant must complete and sign Part A (Claimants Statement). To qualify for benefits, the claimant must be under the care of a licensed or certified physician.  The Physician completes Part B (Health Care Providers Statement). Part C (Employer’s Statement) is then completed by the employer.  This section certifies employment and provides the necessary information needed for the insurance carrier to process the claim.  The completed DB-450 should be filed promptly.

Is There A Time Limit For Filing A Claim?

Yes. A Claimant must file a claim within 30 days after they become disabled. If a claim was filed later, and unless the claimant can prove that it was impossible to file sooner, benefits will not be paid for any disability period more than two weeks before the claim was filed. If a claim is filed more than 26 weeks after their disability begins then no benefits will be paid.

Can A Claimant Appeal A Rejected Claim?

Yes. The claimant may appeal the carrier’s decision directly to the Worker’s Compensation Board within 26 weeks after receiving a notice of total or partial denial (DB-451). The Board will examine the case and hold a hearing to determine if benefits should be paid.

Are DBL Benefits Taxable?

Yes. Benefits must be reported as income.  The third party payer (insurance carrier) is required to withhold FICA from DBL benefits and report to the employees all benefits paid to the claimants.
